2) Nature of Services
Leadsmagnet.ai provides a software platform for outbound calling, lead management, and communications automation. We do not initiate or conduct calls or messages on your behalf; you control all content, contact lists, numbers, and campaign settings.
3) Compliance Is Your Duty
You must ensure full compliance with all applicable laws, regulations, and industry guidelines, which may include CASL, CRTC rules, TCPA, FCC rules, and DNC requirements.
4) Prohibited Uses
Unlawful, harmful, harassing, deceptive, or fraudulent activity; calling harvested lists; spoofing; violating DNC rules.
5) Customer Data & Privacy
You own your contact lists and content. You grant us a license to process such data solely to provide and improve the Services.
6) Fees, Taxes & Refunds
Fees are due per your plan/order. Except where required by law, fees are non-refundable.
7) Indemnification
You agree to indemnify and hold harmless Leadsmagnet.ai from any claims arising from your campaigns, content, or legal non-compliance.
8) Limitation of Liability
We are not liable for indirect damages; our aggregate liability is limited to amounts paid in the 3 months preceding a claim.
9) Governing Law & Venue
These Terms are governed by the laws of Ontario, Canada, with disputes resolved in Ontario courts.
10) Checkout Consent
"By completing this purchase, I confirm that I have read and agree to the Leadsmagnet.ai Terms of Use and understand that Leadsmagnet.ai provides outbound calling software only. I am solely responsible for the content, legality, and compliance of all calls and messages made using the service, including adherence to applicable laws such as TCPA, CASL, DNC rules, and relevant telemarketing regulations."
